Terms & Conditions

These Terms and Conditions ("Agreement") are entered into between Trufast Drylining Supplies, a trading name of C&M Ltd (registered in England 15570139, 2a Blackthorn House, Birmingham, B3 1RL) ("Trufast Drylining Supplies", "we," "us," or "our") and the customer ("Customer," "you," or "your") who makes purchases from us. These terms apply to any purchases made from us either via our website, email, or telephone.

1. Definitions

1.1 Business Customer: You are a business customer if you are purchasing products from us for use in your trade, business, or profession.
1.2 Consumer: You are a consumer if you are purchasing products wholly or mainly for personal use, outside of your trade, business, or profession.

2. Business-to-Business Sales

2.1 Exclusively B2B: Trufast Drylining Supplies operates as a business-to-business (B2B) supplier and sells products exclusively to trade customers. By placing an order, you confirm that you are purchasing on behalf of a business for use in your trade or profession. As a result, consumer rights and protections under the Consumer Rights Act 2015 do not apply to your purchase.
2.2 Entire Agreement: This Agreement constitutes the entire agreement between Trufast Drylining Supplies and the Customer. You acknowledge that you have not relied on any statements or representations not expressly included in this Agreement.

3. Orders and Delivery

3.1 Order Placement: Orders can be placed via email, telephone, or through our website. By placing an order, you are making an offer to purchase the products in accordance with this Agreement.
3.2 Order Acceptance: All orders are subject to acceptance by Trufast Drylining Supplies. We reserve the right to accept or reject any order at our sole discretion. A contract will only be formed when we confirm acceptance of your order via email or in writing.
3.3 Delivery: Trufast Drylining Supplies will make reasonable efforts to deliver the products within the agreed-upon timeframe. However, delivery dates are estimates and may be subject to change due to factors beyond our control. Trufast Drylining Supplies is not liable for any delivery delays caused by circumstances outside our control.
3.4 Changes to Orders: If you wish to make changes to your order after it has been placed, please contact us as soon as possible. We will inform you if the changes are possible and advise on any changes to pricing, delivery times, or other details.
3.5 Signed Deliveries: All deliveries must be signed for by the Customer or an authorised representative.
3.6 Missed Deliveries: If no one is available at the delivery address to sign for the delivery, additional charges may apply for redelivery. We will notify you of any extra costs for storage and re-delivery.

4. Delivery Shortages, Damages, and Wrong Products

4.1 Inspection on Delivery: It is the Customer’s responsibility to inspect all products upon delivery. Any parcels that appear damaged upon arrival should be checked in front of the courier’s delivery person, and any damage should be noted on the delivery receipt and signed for accordingly.
4.2 Reporting Damages and Shortages: Any claims for shortages, damages, or incorrect products must be reported to Trufast Drylining Supplies by telephone within 24 hours of delivery and confirmed in writing within 3 working days of despatch.
4.3 Failure to Report: Failure to notify us of any issues (e.g., damages, shortages, wrong products) within the specified timeframes will result in Trufast Drylining Supplies being unable to process your claim or offer a replacement or refund.
4.4 Liability for Damage: Trufast Drylining Supplies will not be liable for any damages, shortages, or incorrect products that are not reported within the required timeframe.

5. Returns

5.1 Returns for Business Customers: As a business customer, you have the right to return products within 7 working days after receiving delivery, unless the product is non-returnable as described in Section 5.5. Returns must be authorised by us in writing prior to being sent back. Returns without prior authorisation will not be accepted.
5.2 Customer Responsibility for Returns: It is the responsibility of the Customer to arrange and pay for the return of the products. Trufast Drylining Supplies will not cover return shipping costs.
5.3 Restocking Charge: All authorised returns are subject to a restocking charge of 25% of the invoiced price. The restocking charge will be deducted from the refund issued to the Customer.
5.4 Condition of Returned Products: Products must be returned in their original, unopened condition and packaging. Damaged or unsellable products may be subject to additional charges or may not be eligible for a refund.
5.5 Non-Returnable Products: Some products, such as those which are bespoke, made to order, are non-returnable. These will be clearly marked on the product pages, and we will also notify you in writing after the order has been received.

6. Refunds

6.1 Processing Refunds: Refunds will be processed within 14 days of receiving the returned products, provided that they meet the return conditions.
6.2 Deductions from Refunds: If the returned products are not in their original condition, we may deduct an amount from your refund to reflect any reduction in the product's value caused by your handling of it beyond what is necessary to establish its nature, characteristics, and functionality.
6.3 No Refunds for Sale or Return: We do not offer refunds for goods purchased on a sale or return basis unless the product is faulty or mis-described.

7. Payment and Pricing

7.1 Pricing: The prices for products are as stated in our current price list or as otherwise agreed in writing between Trufast Drylining Supplies and the Customer. Prices exclude VAT and any other applicable taxes unless otherwise stated.
7.2 Payment Terms: Payment is required at the time of placing your order unless otherwise agreed in writing. Trufast Drylining Supplies reserves the right to cancel or withhold orders if payment is not received as agreed.
7.3 Price Changes: We reserve the right to amend product pricing at any time. However, the price stated at the time of order placement will apply to that specific order.

8. Same Day Delivery through DryliningNOW and Trufast Drylining Supplies

8.1 Same Day Orders: Same day delivery orders can be placed through our website. All orders are subject to acceptance by Trufast Drylining Supplies. We reserve the right to accept or reject any order at our sole discretion.
8.2 Same Day Delivery: Same day deliveries are available Monday to Friday between 7 AM and 6 PM. Estimated times of arrival are subject to change. Trufast Drylining Supplies will not be liable for any delays or failure to deliver caused by factors beyond our control.
8.3 Same Day Cancellations: You can cancel an order without charge if it has not yet been picked up by the driver. Once the driver has collected the order and is en-route to the Customer, you will be liable for 100% of the courier charges, plus a 25% restocking fee for the goods.
8.4 Incorrect Address for Same Day Delivery: If we are unable to deliver an order because of an incorrect address, we will make all reasonable efforts to find the correct address. We will notify you of the correction and deliver or attempt to deliver the order to the correct address, although additional charges may apply.
8.5 Waiting Time: The Customer is required to be present at the point of delivery. If the Customer is not present, the driver will return the order to our warehouse in West Bromwich, and you will be liable for 100% of the courier charge, plus a 25% restocking fee of the goods.

9. Products

9.1 Product Variations: Images of products on our website or in brochures are for illustrative purposes only. While we aim to display colours and product details accurately, we cannot guarantee the exact representation of product colours. Your product may vary slightly from the images shown.
9.2 Product Packaging: The packaging of products may vary from that displayed on the website or in promotional materials.

10. Trufast Drylining Supplies' Rights to End the Contract

10.1 Trufast Drylining Supplies' Right to Terminate: We may terminate this contract with immediate effect if you fail to make payment when due, fail to provide necessary information for delivery, or fail to accept delivery after a reasonable period.
10.2 Effect of Termination: If the contract is terminated for any of the above reasons, Trufast Drylining Supplies will refund any payments made for products not yet delivered. However, we may deduct from the refund any reasonable compensation to cover costs incurred as a result of the termination.

11. Limitation of Liability

11.1 Indirect Damages: Trufast Drylining Supplies will not be liable for any indirect, incidental, or consequential damages arising out of or related to the performance or use of the products.
11.2 Maximum Liability: Trufast Drylining Supplies' maximum liability to any claim, whether in contract, tort, or otherwise, is limited to the invoiced price of the specific product giving rise to the claim.

13. Miscellaneous

13.1 Entire Agreement: This Agreement constitutes the entire understanding between Trufast Drylining Supplies and the Customer and supersedes any prior agreements.
13.2 Severability: If any clause of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By placing an order with Trufast Drylining Supplies, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
